保障房项目监督是检察监督范围的扩展,也是司法实践的制度创新,它超出了检察监督的法定范围。在议行合一宪政体制下,监督制度的历史传承、分权制约的制度设计为检察监督范围的扩展提供了理论依据,行政权内部监督不足又为检察监督的介入提供了现实舞台。检察监督范围的扩展是在政府的推动下,以社会综合治理的名义,采取“职务犯罪预防”或“合作协议”的形式而展开。“权力监督”的实质合法性与“旧瓶装新酒”的技术化策略,较好地应对了监督范围扩展的形式违法的质疑。鉴于宪政框架内“以权制权”的制度设计、监督能力的局限,检察监督范围应以公权力监督为限,相对克制地保持权力的边界,既要达到监督公权力的目的,又要遵循检察监督的规律。
