商品房销售(预售)中商品房承购人无论是否自然人,只要不是经营商品房买卖,相对于开发商这一经营者而言均属于消费者,享有充分的知情权。开发商欺诈情形下损害承购人知情权时应承担的法律责任包括惩罚性赔偿责任。
