检察权定位为法律监督权抑或公诉权的争论意义重大。从法律渊源和价值取向两方面论证 ,我国检察权定位为法律监督权是比较合理而且是必然的选择 ;对目前法律监督权存在的问题只需加以完善 ,而不能全盘否定。
The argument that prosecutorial power is located as the power of legal supervision or public prosecution is of great significance. From the perspective of legal origin and value orientation, it is a reasonable and inevitable choice to locate the procuratorial power of our country as the legal supervisory power. The existing problems of legal supervisory power need only be improved and can not be totally negated.
