防范刑事错案重在弄清原因。我国错案直接源于不当的办案行为,罪魁祸首在于失当的侦查。这些不当行为的发生是因为“重实体、轻程序”和“有罪推定”等诉讼观念的误导。不当办案是我国错案发生的表层原因,深层原因主要在于我国关于对“人”理解中的文化预设,并主要通过刑事诉讼运行的非专门化及刑事追诉中无法预期的失控化对错案形成起推动作用。
