随着中国经济的发展和城市化进程的加快,土地成为推动经济发展的重要力量,土地征收现象越来越普遍。土地征收是国家为实现公共利益而强制调整人民土地权益的行为,它的实行关系到我国九亿多农民的切身利益。但是土地征收过程中由于程序的不完善和各种违规操作的存在,导致大量的土地征收纠纷的出现。及时完善土地征收程序,对规范土地征收行为具有重要意义。现从土地征收的制度出发,主要探讨了在土地征收中常常出现的问题,并就如何保护农民的合法权益提供了见解。
With the development of China’s economy and the acceleration of urbanization, land has become an important force for promoting economic development. The phenomenon of land expropriation is becoming more and more common. Land expropriation is the state’s compulsory adjustment of the people’s land rights and interests for the realization of the public interest. Its implementation has a bearing on the vital interests of over 900 million peasants in our country. However, due to the imperfect procedures and the existence of various illegal operations in the process of land expropriation, a large number of land acquisition disputes have arisen. Timely improvement of land expropriation procedures, the regulation of land acquisition is of great significance. Starting from the system of land expropriation, it mainly discusses the problems that often appear in the land expropriation and provides some opinions on how to protect the legitimate rights and interests of peasants.
