一直以来,国际商法和国际经济法合二为一,导致国际经济法这一学科结构庞杂。而国际商法在概念、法律性质、调整范围等各个方面有着自己不同于国际经济法的显著特性,因此本文认为应把国际商法设置成一门独立的学科。
All along, the international commercial law and international economic law combined, leading to a complex international economic law discipline structure. However, international commercial law has its own distinctive characteristics different from international economic law in various aspects such as concept, legal nature and scope of adjustment. Therefore, this paper argues that international commercial law should be set as an independent discipline.
