针对我国法学理论界经常出现的企业名称与商号等关联名称概念使用上的含混，重新界定了企业名称，并将其与商号等概念加以辨析，认为：企业名称与商号及商业（事）名称不同，前者用于各类从事生产经营活动的企业，后者适用于以“商”为主要经营活动的企业，且涵盖个体工商户和个人合伙名称；商号与商业名称、商事名称、厂商名称的概念是同一的，随着我国市场经济的发展，商号一词将被广泛使用；公司名称是企业名称之一种；字号是企业名称的核心构成要素。
