驴行是近年兴起的一种时尚的户外活动,其以新奇、自由,具有探险元素而深得年轻一代的喜爱。但目前我国还没有相关的法律法规来解决日益增多的驴行法律纠纷,就使得国内法院在面对此类问题的时候,做出了截然不同的判决。引起了法律界,社会上广泛的讨论。文章以驴行这种活动形式的特殊性为切入点,引入不同法院对判定驴行组织者承担不同法律责任的案例,比较两次判决所基于的不同法理,借鉴美国风险自负理论,提出适应我国驴行发展的责任分担形式。
The donkey line is a fashionable outdoor activity that has emerged in recent years. It is loved by the younger generation with novelty, freedom and adventure elements. However, at present, there are no relevant laws and regulations in our country to solve the increasing number of donkey legal disputes, thus making the domestic courts face different decisions in the face of such problems. Aroused the legal community, the community extensive discussion. This article takes the particularity of this kind of activity as a starting point, introduces different courts to judge donkey organizers to take different legal responsibility cases, compares the different jurisprudence based on the two judgments, draws lessons from American risk appetite theory, Donkey line development in the form of responsibility to share.
