对公共事件的报道,媒体扮演了信息生产者、信息加工者和信息传递者的角色,通过发挥议程设置和议程引爆功能对立法议程产生压力性影响。由于立法决策信息收集和处理能力受限、立法议程设置阶段公众参与渠道不畅,立法决策者借助媒体获知公众立法需求,并在其压力影响下做出突击性回应决策。这使得立法决策可能面对一系列不利后果:信息失真、信息不对称现象加重、信息结构失衡进而导致信息使用策略的失败。我国立法决策者应当正视媒体信息和公众舆论在互联网时代给立法决策带来的新约束,转变立法规划和立法计划制度的现有功能定位,公开立法议程创建环节的相关信息,增强对代表提案和立法项目建议的科学论证,以保证公众参与在立法资源分配源头环节发挥实质性影响。
In the coverage of public events, the media plays the role of information producer, information processor and messenger, exerting a pressure on the legislative agenda through its agenda setting and agenda detonation functions. Due to the limited capacity of legislative decision-making for information collection and processing, the channels of public participation in the legislative agenda setting phase are poor. Legislative decision-makers use the media to understand public legislative needs and make unseasonable response decisions under the influence of their pressure.
