以往的研究主要关注的是文本问题何以产生“秋菊的困惑”?对此问题的回答基本搭建在二元对立的理论范式基础上,即中国30年法治进程中的中国与西方、传统与现代、精英与大众在法律理念上的一系列冲突。本文试图重新回到《秋菊打官司》的电影文本本身,提出“何以李公安的转变?”这一文本问题,着重分析处于乡村与城市之间游弋的李公安在秋菊的官司中的三次不同的处理方式。基于上述文本的分析,本文力图抛弃以往夹缠在意识形态争论中的理论分析,依托费孝通在《乡土中国》中提出的“教化权”概念来揭示中国社会变迁过程中,自然共同体、社会共同体和政治共同体中不同的秩序与权力结构的冲撞。“秋菊的困惑”与“李公安的转变”表明中国基层治理的核心问题在于如何安置三种秩序中的基层官员伦理。
