目的:综合分析医疗纠纷判决的相关数据,统计归纳医疗纠纷的特点,为医疗纠纷解决提供参考。了解医疗纠纷诉讼办案人员及当事人的相关情况,对医疗纠纷诉讼基本情况做评估。方法:对2010-2015年关于医疗纠纷诉讼判决数据进行分类统计,计算标准化率;对贵阳市南明区法院,贵阳市观山湖区人民法院,贵阳市清镇市人民法院,贵阳市中级人民法院办案人员进行采访,了解相应情况。对医疗纠纷诉讼当事人进行采访,了解当事人的心理状态及行为特征。结论:医疗纠纷诉讼相关数据呈现出一定的规律性,医疗纠纷诉讼中也存在着一些普遍性问题,一定程度上的反映了医疗纠纷诉讼现状和特点。对医疗纠纷的研究还需持续的动态更新和进一步深入探讨。
OBJECTIVE: To comprehensively analyze the relevant data of medical dispute judgments, summarize the characteristics of medical disputes by statistics, and provide reference for medical dispute resolution. Understand the situation of medical dispute litigation personnel and parties concerned, and make an assessment of the basic situation of medical dispute litigation. Methods: To classify the data of medical dispute litigation judgment from 2010 to 2015 and calculate the standardization rate; to investigate the cases of Nanming District Court of Guiyang, Guanshanhu District People’s Court of Guiyang, Qingzhen People’s Court of Guiyang and Guiyang Intermediate People’s Court Personnel interviewed to understand the situation. Interview medical litigation litigants and understand their psychological status and behavioral characteristics. Conclusion: The data of medical dispute litigation shows a certain regularity. There are also some common problems in medical litigation litigation, to a certain extent, it reflects the current situation and characteristics of medical litigation. Research on medical disputes still needs continuous dynamic update and further discussion.
