新刑事诉讼法实施后,非法证据排除制度从司法解释层面上升到立法层面。正确理解非法证据排除规则,有效监督非法取证行为,是保证案件质量、严防冤假错案的一剂良方。根据浙江省在审查起诉环节及审判环节对非法证据排除的数据分析,检察机关对侦查机关非法取证的诉讼监督力度仍不够有力。究其原因,有立法上的缺陷,侦查权的独立、封闭,非法取证后果模糊等。进一步构建完善非法取证诉讼监督机制,从检察机关侦查监督职能出发,还需转变执法理念,强化对非法证据的诉讼监督意识;走出书面审查模式,动态静态相结合;建立健全提前介入制度;涵盖对所有证据取得方法的审查和监督;建立检察官对警察的责任追究机制。
After the implementation of the new Code of Criminal Procedure, the system of exclusion of illegal evidence has risen from the judicial interpretation level to the legislative level. Correctly understanding the rules of exclusion of illegal evidence and effectively supervising acts of illegal evidence collection are good prescriptions for ensuring the quality of the case and preventing unjust and false cases. According to the data of Zhejiang Province in examining and prosecuting the prosecution and the adjudication of illegal evidence, the procuratorial organs are still not vigorous enough to supervise and prosecute the illegal forensics of the investigation organ. The reason, there are legislative defects, the independence of investigation, closure, the illegality of illegal evidence and so on. To further establish and improve the supervision mechanism of illegal forensics litigation, starting from the investigation and supervision functions of procuratorial organs, we also need to change the concept of law enforcement and strengthen the awareness of litigation over illegal evidence. Out of the written examination mode, the combination of dynamic and static conditions, establish and improve the early intervention system, Review and supervision of all evidence obtaining methods and establish prosecutor responsibility investigation mechanism for police officers.
