当下,国防行政法成为军事法学界研究的一大热点问题。2008年,曾志平申报的“国防行政法”课题被遴选立项为国家社科基金项目。之后,学者们从宪政、军事法在中国特色社会主义法律体系中的地位以及军民融合等多角度对此问题进行了较为深入的讨论,结合学界已有的研究成果,笔者主要从方法的视角谈谈对此问题的认识和看法。
