社区服务作为一种极富教育矫正功能的刑罚措施,在引入我国刑罚体系时,应充分考虑到我国刑罚结构的具体情况和刑事司法实践的实际需要,并借鉴国外已有立法经验,不宜设置独立的社区服务刑种。应在刑罚暂缓执行的框架下构建我国的社区服务制度,即将社区服务与缓刑、假释制度相结合,使社区服务成为缓刑、假释的一种附加义务。
As a kind of penalty measure which has very educational correction function, community service should take full consideration of the actual situation of the criminal penalty structure and the actual need of criminal justice practice in our country when introducing the penalty system in our country. It is not appropriate to set up an independent Community service torture. The system of community service in our country should be constructed under the framework of suspension of punishment. That is to say, combining community service with the system of suspended sentence and parole, make the community service an additional obligation of probation and parole.
