司法鉴定结论失真是诉讼中的一个常见问题,司法鉴定有“鉴”不“定”的混乱局面已经使司法鉴定的公信力下降,致使案件久拖不决影响诉讼效率的实现。要防止和排除鉴定结论失真,就必须对鉴定失真有一个充分的认识。本文通过探讨司法鉴定结论失真的特点与来源,提出预防失真的几点措施。
Judicial identification of the distortion of the proceedings is a common problem in litigation, judicial identification of “Kam ” is not “fixed ” chaotic situation has led to the credibility of forensic expertise declines, resulting in a long delay in the case affect the realization of litigation efficiency. To prevent and eliminate the distortion of the identification conclusion, we must have a full understanding of the identification of distortion. In this paper, by exploring the characteristics and sources of forensic conclusions, some measures to prevent distortion are put forward.
