意思自治原因是民法的基本原则,贯穿于民事活动中。现代民法对意思自治原则进行了一定的限制,但是民事法律关系中意思自治仍然是基本原则。在司法实践中应当尊重当事人的意思自治。
The reason of autonomy is the basic principle of civil law, which runs through civil activities. The modern civil law has made some restrictions on the principle of autonomy of will, but the autonomy of will remains the basic principle in the relationship between civil law. The judicial autonomy should be respected in the judicial practice.
