国际私法产生于不同法域民商事交往之需求,由于世界政治经济在不同阶段民商事交往也有其阶段特征,国际私法必然也处于动态之中。而在世界发展不同阶段总有与之相应的社会思潮作为指导,这种指导作用反映在各国民商事交往领域之中,即不可避免地对国际私法的性质产生影响作用。在当今世界主义思潮的影响下,传统国际法范围扩大和国际私法内部国际法因素的增加,使国际私法最终向着国际法的方向发展。
Private international law arises from the need of exchanges of civil and commercial affairs in different jurisdictions. Since the world political and economic exchanges between civil and commercial affairs also have their own stage characteristics, private international law must also be in a dynamic state. In the different stages of world development, there are always corresponding social ideological trends as a guide. This guiding role is reflected in the field of exchanges between the civil and commercial sectors in various countries and will inevitably have an impact on the nature of private international law. Under the influence of today’s cosmopolitanism, the expansion of the traditional scope of international law and the increase in international law within the field of private international law have made it possible for private international law to finally develop in the direction of international law.
