食品安全关系国计民生,由于转基因食品增加了食品安全问题的复杂性从而引发社会各界的广泛关注。尽管《食品安全法》和《农业转基因生物安全管理条例》等法律法规的出台为转基因食品安全保护提供了必要的法律依据,但是转基因食品安全仍存在一定问题,相关环节中多头监管以及部分监管冲突等问题并未得到有效解决。文章梳理现有法律框架下散落在部门规章中转基因食品安全的规定,提出我国转基因食品安全法律保护方面存在的问题,并针对完善转基因食品安全提出切实可行的法律对策。
Food safety has a bearing on the people’s livelihood and the people’s livelihood. This has caused widespread concern in the community due to the increased complexity of food safety issues caused by genetically modified foods. Although the promulgation of the laws and regulations such as the Food Safety Law and the Regulations on the Safety of Agricultural Genetically Modified Organisms provides the necessary legal basis for the safety protection of genetically modified foods, there are still some problems in the safety of genetically modified foods. In the relevant sectors, long-term supervision and partial regulatory conflicts And other issues have not been effectively resolved. The article combs the provisions of the safety of genetically modified foods scattered in the departmental rules under the existing legal framework, puts forward the problems in the legal protection of the safety of genetically modified foods in our country, and puts forward the feasible legal countermeasures for improving the safety of genetically modified foods.
