旅游购物回扣,已经成为旅游界一个热点话题,本论文在查阅国内外有关旅游购物回扣文献的基础上,发现导游购物“回扣”有其存在的合理性,即在国外,导游收旅游购物回扣是合法行为,为我国实施导游收购物“回扣”合法化提供了现实依据;导游合法薪酬低,回扣是其生存的主要来源;导游工作要求高,风险高,“回扣”是一种经济补偿等等。接着在阐述了我国关于旅游购物“回扣”问题法律欠缺的基础上,提出建立相应的法律体制来保障旅游购物回扣成为一种旅游商店支付给旅行社和导游的合法佣金。
