当前,劳动教养正处改革的关键时期,从构建和谐社会的要求出发,按照现代法治的精神,审视、研究和确立劳动教养改革的价值取向,对于从根本上解决劳动教养改革中所面临的矛盾冲突,加快建立科学、先进的现代违法行为教育矫治制度意义重大而深远。首先,劳动教养改革要以追求社会公平正义为首要价值,通过规范正义、平等正义和程序正义,实现人权保障的法治化;其次,劳动教养改革要以提高功能效益为根本价值,在执法维权、教育挽救和改善恢复等方面,实现整体效益的最大化;第三,劳动教养改革要以创新实践为路径价值,确立和谐的思想理念,创建开放的社会化管理模式,实行科学的专业化矫治,建立规范的运行机制,使劳动教养的改革达到预期的目标。
