十四届三中全会的《决议》指出:“国有企业实行公司制,是建立现代企业制度的有益探索。”八届人大常委会第五次会议审议通过的《中华人民共和国公司法》(以下简称《公司法》),总结了我国企业改革的成功经验,参照国外企业管理的有效做法,根据社会主义市场经济发展的需要,将公司做为现代企业制度的一种模式,用法律固定下来,这对深化企业改革,促进经济发展,将会产生巨大的作用。
