当前,互联网已成为经济全球化的重要媒介,其已发展影响至我们生活的方方面面。当商业的竞争延伸到网络中时,高科技战争就随之展开了。在这场战争中,虽然域名只是字符标记,但因其所具有的独立的识别功能,开始取得无可比拟的商业实践价值。也正因如此,存在于网络虚拟空间中的域名,已成为重要的商业性标记,所以法律应当对其所有人给予相应的保障。到目前为止,对域名权的保护问题法律没有明确规定,文章在研究有关域名的几个问题的同时,对域名的法律保护问题进行了探讨。
At present, the Internet has become an important medium for economic globalization, which has affected the development of all aspects of our lives. As commercial competition extends to the Internet, a high-tech war unfolds. Although the domain name was only a mark of character in this war, it has begun to gain unparalleled commercial value because of its independent identification capabilities. For this reason, the domain name existing in the virtual space of the network has become an important commercial mark, so the law should provide corresponding protection to its owners. So far, the law on the protection of domain name rights has not been clearly stipulated. While studying several issues concerning domain names, the article probes into the legal protection of domain names.
