看待司法民主必须有一种多向度的视角。司法的直接民主与代议制民主、司法的回应型民主与协商民主、司法的程序民主与实质民主等共同体现出司法民主的多重价值与功能。在单向度视角下,我们期望人民陪审员制度承载过多的、其本身难以实现的功能。多向度的司法民主观可以有效地回应理论界对司法民主理论的质疑,也为我国的司法民主化建设指明新的方向。我国事实上已经开始了多向度司法民主建设的实践。
There must be a multi-dimensional perspective on judicial democracy. Judicial direct democracy and representative democracy, judiciary responsive democracy and consultative democracy, judiciary procedural democracy and substantive democracy all reflect the multiple values and functions of judicial democracy. From the perspective of one-wayness, we expect that the system of people’s assessors will carry too many functions that are difficult to achieve by itself. Multidimensional judicial democracy can effectively respond to the theory of judicial theory of democracy questioned, but also for our country to establish a new direction for the democratization of the judiciary. In fact, our country has begun the practice of multi-directional judicial democracy.
