政治学和政治争论的中心问题占据着现代法理的讨论,其可以被归纳为:实际上,所有的现代法理学都依赖于法律推理与政治推理这一区分。一端是法律分析或法律推理,另一端则是政治论争或政治哲学,它们被认为是清晰可辨的两种迥然不同的话语实践(discursive practices)。然而,在法律与政治之间是否存在某种一般性的关联以及这种关联如何在法理论(legal theory)中反映出来,这些问题很显然不是最近才出现的。
The central issue of political science and political debate occupies a discussion of modern jurisprudence that can be summed up as follows: In fact, all modern jurisprudence relies on the distinction between legal reasoning and political reasoning. One side is legal analysis or legal reasoning, and the other is political controversy or political philosophy, which are considered as two distinct discursive practices that are clearly discernable. However, whether there is some general correlation between law and politics and how this association is reflected in the legal theory, it is clear that these issues have not emerged recently.
