随着商品经济的发展,食品生产经营企业竞争激烈,不法业户虚假标注食品的生产日期现象时有发生.严重损害了消费者利益.本文对我市查处的某违法业户虚假标注过期减肥食品“玉子苗条酥”生产日期一案进行了分析.1 案情简介1995年12月8日,在对某营养保健品有限责任公司进行监督检查时,发现该单位将部分已过期的减肥食品“玉子苗条酥”拆包后.不经任何加工,更换相同的外包装重新打印生产日期.准备对外批售.依据《食品卫生法》第21条、46条规定,销毁了全部过期食品792kg.并处5000元罚款.在诉讼期限内该单位交纳了罚款,此案终结.2 产品来源及违法事实调查该违法业户为私营企业,其改制的过期“玉子苗条酥”并非该公司生产.据查.该公司于1995年1月10日与“玉子苗条酥”的原生产厂签定了购买产品配方、机械设备、原材料等合同.包括厂家批售到市场上还未结算的200箱产品.由于产品滞销、到10月份市场上
