《物权法》对政府的行政行为提出了许多新的要求。诸如政府在拆迁征地、城市开发与城市规划、用地审批、公共设施设置、财产方面的税收征收等方面,必须树立物权观念,必须注意尊重和保护私人财产的所有权等。本文是从分析城市房屋拆迁这一行政执法行为中存在的问题入手,探寻《物权法》的出台对完善城市房屋拆迁制度的影响,并以此寻找解决问题的路径和措施。
“Property Law” put forward many new requirements for the government’s administrative behavior. Such as the government in the demolition of land acquisition, urban development and urban planning, land approval, public facilities, property tax collection, etc., must establish the concept of property rights, we must pay attention to respect and protect the ownership of private property. This article starts with the analysis of the problems existing in the administrative enforcement of urban housing demolition. It explores the impact of the “Property Law” promulgated on improving urban housing demolition and relocation, and finds out the ways and measures to solve the problems.
