承发包模式是建筑市场的核心体系,而施工总承包模式在建筑业中是最主要的承发包模式。从目前我国建筑业中总承包的实践来看,建设单位行为的不规范、有关法律法规和行业政策的不完善是突出问题,已经成了行业发展的重大障碍,尤其是当前有关法律法规和行业政策对总承包责任的规定明显缺乏合理性,对总承包责任体系的完善已经产生了抑制作用。如何解决这些问题,是摆在建筑业面前的一个重大课题。
The contracting mode is the core of the construction market, and the construction contracting mode is the most important contracting mode in the construction industry. Judging from the practice of China’s general contracting in the construction industry, the non-standard behavior of construction units, the imperfect laws and regulations and industrial policies are prominent problems and have become major obstacles to the development of the industry. In particular, the current laws, regulations and industries Policy on the general contracting responsibility of the apparent lack of reasonableness, the general contracting responsibility system has had an inhibitory effect. How to solve these problems is a major issue facing the construction industry.
