英国契约法的发展滥觞于违约损害赔偿之诉的出现,它是从侵害令状中分离出来的一种诉讼形式。从14世纪开始,违约损害赔偿之诉逐渐产生并不断扩大其适用范围,从中逐步发展出了一些现代契约法中的理念和原则。
The development of contract law in England originated from the lawsuit of damages for breach of contract. It is a form of litigation separated from the injunction. From the beginning of the 14th century, the lawsuit of compensation for damages for breach of contract gradually came into being and expanded its scope of application. From there, some concepts and principles of modern contract law were gradually developed.
