一、引言1.一切皆流,无物常驻(Panta rhei)“一切皆流,无物常驻”。这句格言一般被认为是起源于古希腊哲学家赫拉克利特。学术界对于这句警句的起源是有争议的,我也承认对于这个问题我本人也不能做出一个准确的回答。不过,知道这是一个古代哲学非常古老的遗物,并且仍然适用于今天的商业和商法,对我而言已经足够了。除了很简单的不变的规则以外,一般而言,法律是处于永恒的变化中的,而这一规律更加适用于商法领域。
I. INTRODUCTION 1. Everything is flowing, Panta rhei “Everything is flowing, nothing is resident”. This motto is generally considered to have originated in the ancient Greek philosopher Heraclitus. The academic community is controversial about the origin of this aphorism, and I admit that I myself can not give an accurate answer to this question. However, knowing that this is a very ancient relic of ancient philosophy, and still applicable to today's business and commercial law, is enough for me. In addition to the very simple and invariable rules, in general, the law is in the process of eternal change, and this law is more applicable to the field of commercial law.
