劳动法律关系是一个由标准劳动关系与非标准劳动关系构成的体系。劳动关系符合法定模式建立标准劳动关系,表现为单一的合同劳动关系;劳动关系不符合法定模式建立非标准劳动关系,包括但不限于事实劳动关系、合同无效之劳动关系、双(多)重劳动关系等。从体系化视角研究劳动法律关系,不仅可以提示劳动关系的本质特征,有利于劳动法律关系再定义,而且可以扩大劳动法的适用范围,以实现劳动法“广覆盖、低保障、严执法”的立法目的。
