英格兰普通法最重要的品性包括“法律至上”的原则以及其独特的“学徒制”法律教育模式。17世纪以后,普通法面临诸多的挑战和风险,国王对普通法的觊觎,利用王权,干预普通法法院的司法审判,以此实现“王权至上”之目的。英格兰王权与普通法之间的博弈,实际上是为了自由。在博弈中,利用普通法,英格兰不断捍卫者其自由的传统。
The most common traits of common law in England include the principle of “supremacy of law” and its unique “apprenticeship” legal education model. After the 17th century, the common law faced with many challenges and risks. The king’s slander of the common law and the use of the royal power interfered in the judicial trial of common law courts in order to achieve “the supremacy of royal authority.” The game between England’s royal power and the common law is actually for freedom. In the game, using the common law, England constantly defended its own free tradition.
