司法三段论的演绎推理是法律推理的重要形式之一,但是很多学者对司法三段论的形式性进行批判,即对大前提应用中形式主义的批判,而不是针对三段论本身进行的批判。不过三段论在司法中的有效应用很大程度上依赖于大前提的确定。司法三段论的演绎推理在法律推理中具有其独特的作用,是重要的法律推理方式。
The deductive reasoning of syllogism is one of the important forms of legal reasoning. However, many scholars criticize the formality of syllogism of judicature, that is, the criticism of formalism in the application of grand premise, rather than the critique of syllogism itself. However, the effective application of syllogism in the judiciary depends to a large extent on the determination of the premise. Judicial syllogism deductive reasoning has its unique role in the legal reasoning is an important way of legal reasoning.
