[编者按]近二十年来,我国的社会发展变化非常大,基本上完成了从计划经济向社会主义市场经济的转化过程;与此同时,国人在政治、思想、文化、社会管理方面也发生了深刻的变化,由此导致人的观念也有了很大的变化。婚姻法应该如何适应这些变化,司法实践又应该如何处理变化中存在的问题,就成为一个值得我们关注的大问题。前不久,最高人民法院通过中国法院网公布了《关于适用<中华人民共和国婚姻法>若干问题的解释(三)》(征求意见稿)并向全社会公开征求修改意见和建议。以此为契机,本刊特邀请了一些在我国婚姻法研究领域较有影响的专家、学者,就征求意见稿中若干值得关注的问题进行学理探讨。
[Editor’s note] In the past 20 years or so, China’s social development has changed so drastically that the process of its transformation from a planned economy to a socialist market economy has basically been completed. In the meantime, compatriots have also taken part in politics, ideology, culture and social management A profound change, which led to the concept of man has also undergone great changes. How to adapt to these changes in the law of marriage, judicial practice and how to deal with the problems that exist in the changes, it becomes a big problem worthy of our attention. Not long ago, the Supreme Court of People’s Republic of China released the “Interpretation on Several Issues Concerning the Application of the Marriage Law of the People’s Republic of China (Third)” (Draft for Comment) through the China Court Network, and publicly solicited comments and suggestions for amendment to the whole society. Taking this as an opportunity, we invited some experts and scholars who are more influential in the research on marriage law in our country to conduct some academic discussions on some issues of concern in the draft.
