善意取得制度是物权法上的一项重要制度,对保护交易安全、维护社会经济的稳定具有重要意义。各国大多都承认动产善意取得制度,但对不动产交易能否适用善意取得,各国立法都有所不同。我国物权法明确肯定了不动产善意取得制度,但该制度仍有许多问题值得探讨。本文拟从不动产善意取得制度的基本理念、建立不动产善意取得的基础及具体适用进行初步的剖析,以期对在未来的法律规范中进一步完善。
Goodwill acquisition system is an important system of property law, which is of great significance to the protection of transaction security and the maintenance of social and economic stability. Most countries recognize the acquisition of movable goodwill, but the applicability of real estate transactions can be obtained in good faith, national legislation is different. China’s real right law explicitly affirmed the acquisition of real estate bona fide, but the system there are still many problems worth exploring. This article intends to obtain the basic concept of goodwill from the immovable property in good faith, to establish the foundation for the goodwill acquisition of immovable property and to conduct preliminary analysis on the specific application so as to further improve the legal norms in the future.
