法条标题是法条正文之外,以醒目的字体、字号,放置在法条正文首部,用尽可能简练的文字和特殊的语法结构,直接揭示法条内容或类型的一种文字表述方式。法条标题在法律文本构成、法制建设方面都具有重要的作用。法条标题是法条的重要组成部分,它对权利义务的安排、职权职责的确定都产生直接的影响,其本身就是一种立法活动,宜由立法机关根据法律规定的职权与程序,统一设置。法条标题的设置在内容上、形式上须遵循相应的立法技术规则。
