遗嘱生效确认程序就是在办理遗嘱继承公证时,对被继承人生前所立遗嘱是否生效的确认程序。此程序目前并没有明文的规定,我处在经历了多例复查案件之后,于2004年依《继承法》的规定,结合实际的遗嘱继承公证工作程序加以完善形成了现有的操作流程。五年来,我处涉及遗嘱继承复查的案件全部通过复查解决,未发生一起诉讼,也未撤销过一份遗嘱或继承公证书。
Confirmation of the will of the will is the process of confirmation of the validity of the will given to the decedent in the event of notarization of a will. This procedure is currently not expressly provided for. After going through multiple review cases, I completed the existing operation procedures in 2004 according to the “Succession Law” and in combination with the actual testament succession notarization procedures. In the past five years, all the cases involved in the test succession and reexamination have been solved through the review. No lawsuit occurred, nor a will or succession notarized certificate.
