二、实施保险法两年多来遇到的问题 (一) 保险法在立法上存在的问题 《保险法》是新中国成立以来颁布的第一部保险大法,在原有立法经验比较欠缺的情况下,我国仅用了三年多时间就制定出这样一部兼顾国际惯例和中国国情的保险基本法,可以说是一件了不起的事。但是,从执行两年多的情况看,正象任何一部法律都必然存在不足一样,保险法在立法上的问题也逐渐暴露。这主要表现在以下一些方面:
