近年来,城市内涝灾害频发,不仅严重影响社会秩序和城市规划,更危及城市居民的切身利益,充分保障居民权益的呼声愈发激烈,政府作为应对内涝灾害的组织者和实施者,其保障居民权益的责任尤为重要。运用文献研究和调研访谈的研究方法,从理论和法理的视角来看在城市内涝时政府是否需要承担责任,明确政府应该承担的居民权益保障责任的内容,政府履行责任的状况及原因分析,居民对政府履职情况的满意度,完善政府在城市内涝时更好地承担居民权益保障责任的对策。从城市内涝灾害典型的武汉市出发,研究全国城市内涝灾害下居民权益保障的政府责任,为各大城市提供借鉴。
In recent years, frequent urban waterlogging disasters have not only seriously affected social order and urban planning, but also endanger the vital interests of urban residents. The call for full protection of residents’ rights and interests has become increasingly fierce. Using the methods of literature research and research interviews, we can see from the theoretical and legal perspectives whether the government needs to take responsibility when the city floods, whether the government should bear the responsibility of safeguarding the rights and interests of residents, the government’s responsibility and the reasons for the analysis, residents Satisfaction with the performance of the government and improve the government’s responsibility to protect residents’ rights and interests better when waterlogging in the city. Starting from Wuhan, a typical waterlogging disaster in the city, this paper studies the government responsibilities of protecting residents’ rights and interests under the waterlogging disaster in urban areas and provides reference for major cities.
