法制现代化是由传统人治型社会向现代法制型社会的转型过程。随着改革开放的快速步伐,中国也正向法制社会迈进,如今已经取得了相当的成果。法制现代化是依法治国的必然要求,但以往的政治、经济体制都构成了法制现代化的障碍,使得这一过程并不一帆风顺。同时,随着国家之间法律文化的交流与借鉴增多,法制现代化也面临着挑战。
The modernization of the legal system is the transformation from a traditional human-based society to a modern legal-oriented society. With the rapid pace of reform and opening up, China is also moving toward a legal system. Now it has achieved considerable results. The modernization of the legal system is an inevitable requirement for governing the country according to law. However, the past political and economic systems have constituted an obstacle to the modernization of the legal system, making the process not always easy. At the same time, with the increase of exchanges and reference of legal culture among countries, the modernization of the legal system is also facing challenges.
