法人人格权的民法保护是人格权制度的一项重要内容。法人人格权不同于自然人人格权和法人的财产权,我国法人人格权的民法保护,存在着保护范围过窄、混淆人格权请求权与侵权请求权、未规定非财产损害赔偿等问题。本文提出通过建构我国法人人格权民法保护的新模式,全面保护法人利益。
The civil law protection of corporate personality right is an important part of personality right system. The personality right of legal person is different from the personality right of natural person and the legal person’s property right. The civil law protection of legal personality right in our country has such problems as the scope of protection is too narrow, the right of right of personality right infringement is confused, and the non-property damage compensation is not stipulated. This paper proposes to protect the interests of legal persons in all aspects by constructing a new mode of protecting the civil rights of legal persons in our country.
