管理者的安全保障义务,是近代侵权法发展所确定的一种义务,在世界各国得到普遍的确立。我国《侵权责任法》第37条规定了安全保障义务,但在我国司法实践中,安全保障义务被严重滥用,导致泛化,扩大了本不应当由管理者承担的责任,打破《中华人民共和国侵权责任法》确立的维护行为自由和保护民事权益之间的平衡关系,违背侵权法的根本宗旨。因此,应当严格按照法律规定,在案件事实认定、举证责任分配和法律适用上,准确把握管理者安全保障义务的适用,维护管理者的合法权益。
The manager’s obligation of safeguarding security is an obligation established by the development of tort law in modern times and has been universally established in all countries of the world. Article 37 of China’s Law of Tort Liability stipulates the obligation of safeguarding security. However, in our country’s judicial practice, the obligation of safeguarding security is seriously abused, leading to generalization and expanding the responsibility that should not be borne by managers, breaking the "People’s Republic of China The balance between the protection of freedom of behavior and the protection of civil rights and interests established by Tort Liability Law violates the fundamental purpose of tort law. Therefore, we should strictly follow the laws and regulations, accurately identify the facts of the case, the distribution of the burden of proof and the application of law, and accurately grasp the application of managers’ obligations of safeguarding security and safeguard the legitimate rights and interests of managers.
