湖南省人民政府令第112号湖南省人民政府关于修改《湖南省森林和野生动物类型自然保护区管理实施细则》的决定,已经1998年4月4日省人民政府第7次常务会议通过,现予发布施行。省长杨正午一九九八年五月四日省人民政府决定对《湖南省森林和野生动物类型自然保护区管理实施细则》作如下修改:1、第十六条修改为:“违反本细则规定,有下列行为之一的单位或者个人,由自然保护区管理机构责令其改正,并可以根据不同情节处以100元以上500元以下的罚款:(一)擅自移动或者破坏自然保护区界标的;(二)进入自然保护区不服从管理机构管理的;(三)经批准在自然保护区的实验区内从事科学研究、教学实习或者标本采集的单位、个人,不向自然保护区管理机构提交活动成果副本的。”2、第十七条修改为:“对违反本细则规定,在自然保护区进行砍伐、放牧、狞猎、捕捞、采药、开垦、烧荒、开矿、采石、挖沙等活动的单位或者个人,除可以依照有关法律、行政法规规定给予处罚以外,由县级以上人民政府林业主管部门或者其授权的自然保护区管理机构没收违法所得,责令停止违法行为,限期恢复原状或者采取其他补救措施;对自然保护区造成破坏的,可以处300元以上10000元以下的罚款。”本决定自发布之日起施行。《湖南省森林和野生动物类型自然保护区管理实施细则》根据本决定作相应的修正,重新发布。
