农村土地承包经营权制度是我国农地制度的核心,其完善关系到我国农村土地改革的成败。本文从分析该制度入手,系统分析了承包经营权制度的优点,以及在土地归属、经营权体系化等方面的弊端。在优化农村土地法权制度方面,主张完善土地所有权主体制度、构建农村土地使用制度的物权化体系、确立土地使用权的流转制度。
The system of rural land contract and management is the core of China's farmland system, and its perfection is related to the success or failure of rural land reform in our country. This article begins with the analysis of the system, systematically analyzes the advantages of the system of contracting management right, and the drawbacks in the ownership of the land and the systematization of the management right. In the aspect of optimizing the legal system of rural land, we advocate the improvement of the system of the subject of land ownership, the system of property rights of rural land use system, and the establishment of the circulation system of land use rights.
