在十九世纪末由于清帝国政治动荡,内忧外患,所以征集变法,从而引起了清末修律,制定了许多律法,其中《钦定大清刑律》为众多律法之一,对此律法学者们对其有些很大的争议,史称“世纪礼法之争”。本文通过阅读梁治平先生的《礼教与法律》一文对此有些认识,并通过此文厘清了“世纪礼法之争”关注的重点在何处,具体在本文中指出。
