环境损害填补的模式选择与制度适用

在解决环境所致损害时,应采用“补充”式,受害者可同时主张侵权赔偿、非侵权补偿或社会保险。三者之间,存在小范围的适用位序问题,随着适用条件的逐渐成熟,可以分步采用不同的位序安排。在环境污染所致损害问题上,经历了由侵权损害赔偿制度一元化到侵权损害赔偿制度与多项补偿制度多元并存之变迁,进而发展至由社会保障制度一元化调整,其模式可归纳为三种:单一模式、复合模式和综合模式。
