我国西部民族地区地域辽阔,人口少且居住分散,由于种种原因普遍教育条件、水平差,各方面人才不足,公证行业也相应地缺少通过国家司法考试的高素质人员充实队伍,这些地区公证行业的发展始终滞后。《中华人民共和国公证法》及新《公证程序规则》颁布后,更是严格禁止一人处和无人处执业,规定非公证员不能审批公证案件,否则所出具的公证书不具备法律效力。但是,这些地区的发展、国家西部大开发战略的实施,都需要公证法律服务的支持,公证是地区经济发展中不可替代的一环。本文拟以四川为例,就少数民族地区及其他贫困地区公证处缺员状况做一客观分析,对如何合理解决中西部民族地区公证处执业困难的急迫问题提出一些建议。
In western China, the ethnic minority areas are vast in area, scattered in population and scattered in living conditions. Due to various reasons, the conditions for education are generally poor, and the talents in various fields are inadequate. The notarial profession also lacks sufficient qualified personnel to pass the national judicial examination. The notarized professions in these areas Development has always lagged behind. After the promulgation of the Notary Law of the People’s Republic of China and the new Rules of Notarization, it is even more strictly forbidden to practice one person and no one practicing. The non-notary public can not examine and approve notarized cases, otherwise, the notarized public certificate does not have legal effect. However, the development of these regions and the implementation of the strategy for the development of the western part of the country all require the support of notary legal services. Notarization is an irreplaceable part of the regional economic development. This article intends to take Sichuan as an example to make an objective analysis on the lack of staff in the notarial offices in ethnic minority areas and other impoverished areas and put forward some suggestions on how to reasonably solve the urgent problems in practicing the notarial offices in the ethnic minority areas in the central and western regions.
