当侵权行为导致财产受损时,采用市场价值标准对财产损害进行计算的方法已经在世界范围内得到了广泛的采纳。然而,为使这一标准及其他的替代或补充的标准得到实施,存在着许多有待探讨的理论问题和实务操作上的问题。在这方面,发达国家在长期的实践中积累了丰富的经验,可以为进一步完善我国相关法律制度提供借鉴。
When the infringement led to property damage, the method of using the market value standard to calculate the property damage has been widely adopted in the world. However, there are many theoretical and practical issues to be explored for the implementation of this and other alternative or complementary standards. In this regard, the developed countries have accumulated rich experience in long-term practice and can provide reference for further improving China’s relevant legal systems.
