随着国家知识产权战略实施推进计划的开展,专利申请量呈现了迅猛的增长,这也对专利申请的质量提出了更高的要求。“创造性”作为专利申请的授权重要标准之一,全面体现了专利申请对现有技术的贡献程度。专利法中对于“创造性”的阐述相对抽象,使得申请人,尤其是一些个人申请人,对于创造性的概念难以准确把握。本文从专利审查的角度对“创造性”的含义进行了深度解析,希望对申请人理解“创造性”的含义能够有所帮助。
With the implementation of the national intellectual property strategy to promote the implementation of the plan, the number of patent applications showed a rapid growth, which also put forward higher requirements for the quality of patent applications. “Creative ” as one of the important criteria for the authorization of a patent application, fully reflects the degree of contribution of the patent application to the existing technology. Patent law for “creative ” elaboration is relatively abstract, making the applicant, especially some individual applicants, the concept of creativity is difficult to accurately grasp. This paper analyzes the meaning of “creativity ” from the perspective of patent examination in the hope of helping applicants understand the meaning of “creativity ”.
