随着当前我国经济迅速发展,人们的法律意识迅速觉醒,人们遇到矛盾和纠纷时首要考虑的是通过司法途径解决纠纷,从而维护自己的合法权利。但与此同时由于我国法律存在漏洞,一些人开始钻法律的空子,通过虚假诉讼的方式,捏造虚假信息,制造虚假案件,以便实现其非法目的,损害其他利益相关人的合法权益。本文正是基于此,通过分析虚假诉讼产生的原因,最后提出相关建议,以期能够更为有效的治理虚假诉讼问题。
With the current rapid economic development in our country, people’s legal awareness is rapidly awakening. When people encounter contradictions and disputes, the primary consideration is to resolve disputes through judicial channels so as to safeguard their legal rights. However, at the same time, due to the loopholes in our law, some people began to exploit the law loopholes and falsified false information to fabricate false cases through false litigation so as to realize their illegal purposes and undermine the legitimate rights and interests of other stakeholders. Based on this, this article analyzes the reasons for the formation of false litigation, and finally puts forward the relevant proposals in order to more effectively manage the problem of false litigation.
