在2002年实行的《中国人民共和国政府采购法》(以下简称:《采购法》)中,竞争性谈判作为公开招标外的一种补充采购形式而被正式认可。在实践中,笔者发现:在某些采购领域,相比招标采购方式,竞争性谈判采购方式在更多的领域更能帮助采购人获得更合适的、便宜的标的。但由于法律原因,它仅作为一种补充公开招标的方式,并被禁锢在政府采购领域,并没有发挥其真正的作用。
In the Law of the People’s Republic of China on Government Procurement (the “Procurement Law”) implemented in 2002, competitive negotiation was formally approved as a supplementary form of procurement other than public bidding. In practice, the author found that in some areas of procurement, competitive negotiation and procurement methods can help buyers to obtain more suitable and cheaper targets in more fields than bidding and purchasing methods. However, for legal reasons, it has not played its true role merely as a way of supplementing public bidding and being detained in government procurement.
